Is a lawyer even necessary in the immigration procedures?
Lawyers have an integral and in many pivotal part in the immigration process, which is usually intricate, paperwork-laden, and subject to changing legal standards. The lawyer’s presence does not only determine the result of the case but also how effective and efficient the whole procedure is executed.
First of all, we, the immigration lawyers interpret the law according to the circumstances of each person who seeks entry to Hungary and therefore into the European Union. The immigration system is based on laws and regulations that change really quickly and without any notification in advance. For those applying for residency in Hungary, the process could be quite daunting without the assistance of a lawyer, especially that several forms do not exist outside of Hungary and even the language is difficult and the authorities tend to communicate in Hungarian.
Case assessment and strategic planning represent another important task performed by attorneys. Any submission is preceded by an evaluation of the client’s past (such as work experience, family ties, or humanitarian considerations or committing a crime) and a determination of which residence permit would be the most appropriate to pursue. When dealing with more difficult situations like cases with a history of previous visa denials, overstays, or criminal backgrounds, the need for a professional legal advice becomes even more important.
The documentation process is yet another aspect where the services of lawyers are greatly appreciated. In most immigration cases, there will always be need for the applicants to produce various pieces of documentation, which include identity documents, proof of income, work permits, sponsorships police clearances and so on. The role of lawyers is to see to it that all documentation is in place and ready to submit.
Representing the client is another important function. In Hungary, lawyers are allowed to act on behalf of their clients during correspondence with immigration authorities, attend interviews, and represent them during hearings or appeals. This is particularly significant in cases where there are disagreements over the issue or in cases where applications have been rejected. They are able to appeal the decision and highlight any mistakes made by the immigration authority in making their decision.
In addition, lawyers work as risk managers. There is a lot at stake when it comes to immigration proceedings, and there could be serious ramifications for the client, including denial of entry into the country, the revocation of his or her legal standing in Hungary or even deportation from the country. Lawyers minimize this risk by pointing out potential problems and solve existing ones.
Even though lawyers play a crucial role, we face some difficulties as well. The immigration field might be politically charged, and any changes in the policy happen quickly, forcing lawyers to always be up to date. At the same time, it is often challenging to get legal help due to costs involved, and therefore many applicants seek assistance from other sources.
In summary, lawyers play a crucial role in the process of immigration. They offer their expertise and assistance to those who wish to live and stay in Hungary. Even though it is not mandatory to hire a lawyer, doing so will increase the chances of success and compliance. In case any help would be necessary, feel free to contact me at miskovics@mmmlegal.hu!
