Hungarian citizenship by marriage is possible, but marrying a Hungarian citizen does not automatically make you Hungarian. Instead, Hungarian law provides different forms of preferential naturalisation for spouses of Hungarian citizens, and the correct route depends mainly on your marriage, residence and family circumstances. This distinction matters because there is no single rule saying that everyone married to a Hungarian citizen must wait the same number of years.
Can you get Hungarian citizenship by marrying a Hungarian citizen?
Yes. If you are married to a Hungarian citizen, you may qualify for preferential naturalisation either through residence in Hungary or, in certain cases, through your marriage without having to live in Hungary. Marriage itself does not transfer citizenship. Your Hungarian husband or wife remains the legal connection that can make a preferential route available to you, but you must still submit an application and meet the conditions of the relevant procedure.
For spouses, two routes are especially important:
| Your situation | Possible route |
| You have lived continuously in Hungary for at least 3 years and have been married to a Hungarian citizen for at least 3 years | Preferential naturalisation based on residence and marriage |
| You have been married to a Hungarian citizen for at least 10 years | Preferential naturalisation without a Hungarian residence requirement |
| You have been married to a Hungarian citizen for at least 5 years and you have a child together | Preferential naturalisation without a Hungarian residence requirement |
These routes should not be confused with each other. The conditions that apply to them are different.
This is why I normally start a citizenship assessment by asking not only when you married, but also where you live, what your Hungarian residence history is, whether you have children together and whether your spouse is currently a Hungarian citizen and whether you speak Hungarian or not.
How many years of marriage or residence are usually required?
Depending on the route, Hungarian citizenship by marriage may be available after 3 years of marriage combined with 3 years of consecutive residence in Hungary, after 10 years of marriage without a residence requirement, or after 5 years of marriage if the spouses have a child together.
The differences are easier to understand if we separate the two systems.
1. The 3-year residence and marriage route
A foreign national may qualify for preferential naturalisation if they have consecutively lived in Hungary for at least 3 years before submitting the application and have been in a valid marriage with a Hungarian citizen for at least 3 years. The law also covers the situation where the marriage ended because the Hungarian spouse died.
But this is not simply a “three-year marriage rule”: the applicant must also meet the other statutory conditions applicable to this form of naturalisation. These include, among other matters, having no disqualifying Hungarian criminal record or pending criminal proceedings before a Hungarian court, having secured livelihood and accommodation in Hungary, satisfying the public-security and national-security condition, and meeting the applicable constitutional-knowledge requirement which is checked in Hungarian unless exempt.
There is another practical point that deserves particular attention: not every period spent legally in Hungary necessarily counts in the same way for citizenship purposes. The residence history should therefore be checked before relying on the three-year route.
2. The 10-year marriage route
There is a separate route for a person who has been in a valid marriage for at least 10 years with someone who is a Hungarian citizen when the citizenship application is submitted. This route is particularly important for couples living abroad because the currently effective law does not require the applicant to complete a separate period of residence in Hungary under this provision.
The applicant must nevertheless satisfy the criminal-law and public/national-security conditions specified by the effective law and must prove knowledge of the Hungarian language.
3. The 5-year marriage route if you have a child together
It is possible to apply under this route after at least 5 years of valid marriage to someone who is a Hungarian citizen when the application is submitted, provided that a common Hungarian child has been born to the spouses. The existence of this common child must be proven with the child’s birth certificate, and both spouses must make the required declaration concerning the duration of their marriage.
Do you have to live in Hungary to get Hungarian citizenship through marriage?
No, not in every case: the 10-year marriage route and the 5-year marriage-plus-common-child route can be available without a qualifying period of residence in Hungary. This is one of the most useful features of the simplified marriage route. A foreign spouse living in the United States, the United Kingdom, Canada, Australia or another country may therefore potentially qualify without first moving to Hungary. By contrast, if you want to rely on the preferential route based on 3 years of marriage, qualifying continuous residence in Hungary is an essential part of that route.
So, if someone tells me, “I have been married to my Hungarian wife for four years; can I apply?”, the answer cannot be based on the marriage date alone. I also need to know where the couple lives and what kind of Hungarian residence history the applicant has.
Do you need to speak Hungarian for Hungarian citizenship by marriage?
Yes, Hungarian-language ability is an express requirement of the simplified marriage route, and the authority receiving the application checks the applicant’s Hungarian language skills. This requirement is, however, sometimes underestimated. Under the implementing rules, when an application based on the 10-year or 5-year route is submitted, the competent government official, consular officer or other authorized official checks the applicant’s Hungarian-language knowledge and certifies that the check has taken place. In other words, this is not simply a box to tick on a form, it requires a real language knowledge, a conversational level. This should be distinguished from the constitutional basic knowledge examination that applies to certain other forms of naturalization!
How is the marriage route different from citizenship by descent?
Citizenship by marriage is based on your relationship with a Hungarian spouse, while citizenship by descent is based on your own Hungarian parent or ancestry. These routes may look similar because simplified naturalisation can be relevant to both, but their legal foundations are different:
For example, a person with a Hungarian ancestor may potentially qualify for preferential naturalisation based on Hungarian ancestry and Hungarian-language knowledge. A person relying only on a Hungarian spouse must instead satisfy the conditions of the relevant marriage route.
There is an even more fundamental distinction: some people with a Hungarian parent do not actually need to become Hungarian citizens at all. They may already be Hungarian citizens by operation of law and simply need to prove an existing citizenship as Hungarian law provides that the child of a Hungarian citizen acquires Hungarian citizenship by birth. Marriage does not work this way. You do not become Hungarian automatically when you marry a Hungarian citizen. If you have both a Hungarian spouse and Hungarian ancestry, I would therefore examine the ancestry first rather than automatically assuming that marriage is the best route.
What documents are normally needed for Hungarian citizenship by marriage?
The application normally requires documents proving your identity, civil status, marriage and the Hungarian citizenship of your spouse, together with the documents required for your particular route. The exact file depends on the applicant’s personal history, so a document checklist should be prepared individually.
Typical issues to check include:
- your birth certificate;
- your marriage certificate;
- documents relating to earlier marriages, divorces or the death of a former spouse, where relevant;
- information and documents necessary to establish your spouse’s Hungarian citizenship;
- your child’s birth certificate if you rely on the 5-year marriage route with a common child;
- documents concerning your Hungarian residence, livelihood and accommodation if you rely on a residence-based route; and
- foreign criminal-record documentation if requested by the citizenship authority in a case where the applicant lives abroad.
Foreign civil-status documents may also need to satisfy Hungarian requirements concerning authenticity and translation. The exact requirements depend on the country that issued the document and on the applicable international rules, but prepare for these additional costs during the application procedures!
Another issue is often overlooked. If a marriage or other relevant civil-status event took place abroad and has not yet been entered into the Hungarian civil-status register, Hungarian registration of the foreign event may also need to be addressed as part of preparing the citizenship case.
What does the application process look like step by step?
The process starts by identifying the correct legal route, continues with collecting and checking the supporting documents, and ends with the citizenship decision and, if the application succeeds, the required oath or pledge:
- Identify the correct route: first determine whether you rely on 3 years of qualifying residence and marriage, 10 years of marriage, or 5 years of marriage with a common Hungarian child.
- Check the marriage and citizenship history: the exact dates matter. It should also be confirmed that the spouse has the Hungarian citizenship required by the particular provision at the relevant time.
- Check your residence history if you rely on the 3-year route: do not assume that simply holding a residence permit for three years automatically answers the citizenship-law question.
- Review your civil-status documents: birth, marriage, divorce and children’s records should be checked before filing. Foreign events may also need Hungarian registration.
- Prepare the correct application and supporting documents.
- Submit the application through an authorised authority: depending on the circumstances, citizenship applications may be received by the competent Hungarian authorities in Hungary or by a Hungarian consular officer abroad. Don’t forget: submission in Hungary is always quicker as the post or courier services are not involved.
- For an application under the simplified marriage route, the applicant’s identity and Hungarian-language knowledge are checked when the application is received.
- The authorities verify the information: the citizenship authority can check Hungarian residence data, the duration and legal basis of residence, and Hungarian criminal-record information through the relevant official registers. An applicant living abroad may also be required, upon request, to provide proof of a clean criminal record from the competent authority of their foreign place of residence. Prepare for a few months to get everything done: acquiring the citizenship may take a year or more in many cases!
- A decision is made on naturalisation: naturalisation is not automatic merely because the numerical conditions are met. The application must satisfy all statutory requirements.
- Complete the final citizenship formalities.
If naturalisation is granted, the applicant must complete the applicable oath or pledge procedure.
Frequently Asked Questions
Do I automatically become Hungarian if I marry a Hungarian?
No. Marriage does not automatically give you Hungarian citizenship. It may, however, make you eligible for one of the preferential naturalisation routes available to spouses.
I have been married to a Hungarian for 5 years. Can I apply?
It depends. If you and your Hungarian spouse have a common Hungarian child, the 5-year simplified route may be available. Without a common child, you may need to consider the 10-year marriage route or, if you live in Hungary, whether you qualify under the separate residence-based route.
I have been married for 10 years but have never lived in Hungary. Can I apply?
Potentially, yes. The simplified naturalisation route based on at least 10 years of valid marriage does not itself require a period of residence in Hungary, provided that your spouse is a Hungarian citizen when you apply and you satisfy the other statutory requirements.
Can I apply without speaking Hungarian?
Not under the simplified marriage route. Hungarian-language knowledge is a statutory requirement, and it is checked during the application procedure.
If you are considering Hungarian citizenship by marriage, I can help determine whether the 3-year, 5-year or 10-year route applies to your situation and review the documents before the application is submitted and provide you representation throughout the whole procedure.
